POLL: feature without getting a copy?

yo!

i NEED your help, so everybody just give me a short tip! patrick mcneil from designmeltdown.com asked me if he could feature my online profile yeahyoureright.com in his upcoming book. he claims that the book will "contain over 800 sites" featuring "the very best" artists. on the other hand he denied sending me a free copy when its done, as he claims he is "making next to nothing" with the book because of the time he is investing and stuff. so what would you do? the pros and contras in my eyes:

PRO:

- a free copy is part of a professional deal. even the FLK studio sent me a copy of their book, which was part of non-profit charity campaign

- this guy is making money with that book, hopefully

- nobody knows if that book really reaches the exposure for the artists, that it is supposed to, so a free copy would be nothing more than a compesation


CONTRA:

- a book with 800 of the very best designers? i dont even know 800 designers at all... (well, he claims that only ten of them will be in the portfolio style like mine)

- the legal infos on permission contract say that i am granting VERY explicit rights, see here...


so PLEASE, tell me what you think about it!

so here is what i wrote to patrick after i summed up your feedback:

"hey patrick!

so the essence of the feedback i got by the poll that i installed is, that nobody understands why you ask the artists to grant you that "This material may be used for the book or product named above and in ANY FUTURE ANTHOLOGIES, COMPILATIONS, DERIVATIONS, REVISIONS or EDITIONS thereof, including NONEXCLUSIVE WORLD RIGHTS in all languages and ALL MEDIA including print, broadcast, and electronic, FOR THE LIFE of the Work." this is not going to happen for my work.

also i am definitely not granting that "This material may also be reproduced for advertising, publicity, or other means of promotion for the work." this might only happen with my explicit written permission, which you have to ask for.

in other words: i hereby permit you to use my website and its contents for the first print run of your book. my works may only be published in your book, if its publishment is restricted to the usa. for any future anthologies, compilations, derivations, revisions or editions you have to ask me for my explicit written permission.

i am looking forward to the book,
please tell me when its done.

it's probable that he's making next to nothing, and he's showcasing your work. As long as your fully credited it is a great opportunity to promote your self.

I agree with ~attnearth but I'd still try my best to negotiate a free copy out of him. If he still refuses, oh well. 'Least your name's in a book somewhere on his list of the 'top 800 bla bla bla' - ten of which you'll actually be competing with.

naja, ich denk kostenlose promo ist in der Regel nicht so übel, oder? Also wenn das mit der top-10-Auslese so stimmt hört sich das wirklich nicht so verkehrt an. Bei 800 designern wär nen gratis Buch für jeden etwas zu viel verlangt. Zumals ja eher nen Sparten-Buch ist und die Auflage dementsprechend nicht so exorbitant hoch sein wird.
Die rechtliche Situation bezüglich Copyrights auf deine Sachen kann ich nicht so recht beurteilen, da kenn ich mich 0 aus.

hmm.. this is a tricky one, how much does the book cost when it gets to the shops?
Generally i would say free exposure yes i am in, BUT you have a good point, it is not very professional to not get a free copy of the book you are contributing to. Actually the publisher/design/editors usually offer that without you even having to ask for it...

I just read the copyrights etc.. and now i would actually say, free exposure, no thank you.
You basically hand over all rights.
The problem that i see is that it states, "in any future anthologies, compilations, derivations, revisions or editions thereof, including nonexclusive world rights in all languages and all media including print, broadcast, and electronic, for the life of the Work.".
Essentially you hand over your work for free and it could end up being used in a 3 Billion Dollar campaign by coke and you wouldnt see a dime.

So my recommendation: Stay away from it!

good point, thats exactly what i a thinking! in fact it doesnt really mean that coke can use my work, but it means that patrick mcneil can use my work without any limits of time and in all media. i mean it'd be a different thing, when he asked for the rights just for publishing this book one time.

yea, after typing this i just about again and was like, wait a minute, only he gets the rights, but still the point remains. Why would he need "all rights" if he just wants to publish the book?
So yea, be careful.
